3. Collection and processing of your personal data (data processing)

For the purposes of the General Data Protection Regulation, data processing means (EU) 2016/679 („DSGVO“) following: any operation carried out with or without the aid of an automated process, as well as any series of activities related to personal data, such as collection, recording, classification, storage, adaptation or alteration. But also the retrieval, reading, use, disclosure by transmission, dissemination or any other form of provision, comparison or linking, restriction, erasure or destruction (Art. 4 Nr. 2 DSGVO).

3.1 When you visit our website, certain information about the browser and operating system, the date and time of the visit and the access status is stored. This also includes which functions of the website were used by you, how often individual contents were accessed by you, which respective file was accessed, as well as the amount of data that was transferred. Web pages from which you may have accessed our homepage, as well as web pages that you call up from our site, are also part of the stored content. It is important for security, as well as for the prevention and detection of attacks on our homepage, to store the IP address and the name of your internet service provider. We do this for a period of seven days.

3.2 We only store further personal data if you inform us of this and allow us to do so. This applies, for example, to registration, the contact form, a survey, a competition or in the case of a contract. But even in these cases, only after you have given your consent and in accordance with the legally applicable legal provisions.

3.3 Your personal data can be deleted at your request (see also 6. Your rights). There is also neither a contractual nor a legal obligation to provide us with your personal data. However, some functions on our website are dependent on the provision of personal data. If you do not wish to provide us with personal data in this context, certain functions cannot be used or cannot be used in full.

3.4 Place of data processing

Your personal data will only be processed within the European Union.

4. Personal data

Personal data, such as your name, address, date of birth and telephone number, which you have provided to us, will only be used for the purposes for which you have given us this data, e.g. to answer your enquiries, to process contracts concluded with you and for technical administration. Your personal data will only be transferred to third parties if it is necessary for the purpose of processing the contract. For example, the transfer of order data to suppliers will make this necessary. Your personal data will only be passed on to third parties if this is necessary for billing and processing purposes or if you have given your prior consent.

Your personal data transmitted to us will not be passed on to third parties without your consent. Exceptions to this are cases in which we are obliged to release the data due to mandatory legal regulations, e.g. for the purpose of criminal prosecution, to fulfil the legal tasks of the constitution protection authorities or to avert danger. This only on the order of the competent authorities. You can revoke your consent with effect for the future at any time. The stored personal data will then be deleted if you revoke your consent to the storage, if knowledge of this data is no longer required to fulfil the purpose pursued with the storage or if its storage is not permitted for other legal reasons.

There is no transfer of data to third countries.

4.1. Protection of your personal data

We use SSL encryption for our website when it comes to the transmission of confidential or personal content of our users. SSL encryption is activated, for example, when processing payment transactions and when you make enquiries to us via our website. Please make sure that SSL encryption is activated on your side for corresponding activities.

The use of SSL encryption is easy to recognise: The display in your browser line changes from http:// to https://. Send your confidential information only with secure, activated SSL encryption and contact us in case of doubt.

In doing so, we must point out that data transmission on the internet cannot be completely protected against access by third parties and may have security gaps. We, the Marcus Kümpel | Jaguar - Kümpel, hereby object to any commercial use and disclosure of your data.

We assume no liability for external links that lead to third-party content, despite careful checking.

The contact details in our imprint for commercial advertising is not desired unless prior written consent has been given.

5. Usage-related data

Access to websites is automatically registered by every web server. When you visit our homepage, our web server temporarily stores each access in a log file (server log files). The following data is recorded and stored until automated deletion:

  • IP address of the requesting computer
  • Date and time of access
  • Name and URL of the retrieved file
  • Transmitted data volume
  • Message whether the retrieval was successful
  • Recognition data of the browser and operating system used
  • Website from which the access is made

The processing of this data is important because it enables the use of the website (connection establishment) and serves system security, the technical administration of the network infrastructure and also the optimisation of the internet offer.

We collect data on every access to the server (so-called server log files). They are used to analyse attacks on our website and for technical error analysis. The following information is collected:

  • the URL you requested
  • Browser type/ browser version
  • Operating system used
  • HTTP-Answer-Code
  • Referrer URL
  • Host name of the accessing computer

By default, the log files are automatically deleted every 14 days. This is how our web server is configured. We will temporarily extend the storage time of the log files (manually) or individual IP addresses (manually or automatically) if this is necessary for legitimate security reasons.

  • The recipient of the data is our web hosting provider. A transfer of data to a third country does not take place. The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

We will use the data for the purposes stated in the consent and store it in accordance with the legal retention period. Further use of the data from the contact form will only be used in an anonymous manner for statistical purposes (e.g. number of enquiries, success rate of enquiries, etc.).

The data entered in the contact form is processed exclusively on the basis of your consent (Art. 6 para. lIt a DSGVO). Internally, your data will be processed by the responsible contact person in order to forward your request. The data will not be passed on to third parties without your consent.

Plug-ins from Twitter, Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA ("Twitter") are integrated on our website. For this purpose, we use Twitter buttons with which our Twitter account can be called up and Twitter share buttons with which the content of our website can be shared via your Twitter account. We also use a widget from Twitter with which we integrate the timeline of our most recent tweets into our website and make them visible.

When you visit our website, your browser establishes a direct connection to a Twitter server and the content of the plug-ins is transmitted directly to your browser and integrated into the website. In the process, certain data is automatically transmitted to Twitter in the USA and stored there. The data includes connection data (your IP address, date and time, the URL called up), the browser type and the operating system.

If you are logged in to Twitter when you call up our website with the plug-ins mentioned, your account information is transmitted to Twitter, which enables Twitter to identify you directly via your profile and to associate you with your visit to our site. When you click a button, further data is transmitted to Twitter and saved to your profile.

Twitter's privacy policy at https://twitter.com/privacy contains information on the type, scope and purpose of data processing by Twitter.

If you want to prevent Twitter from receiving the aforementioned data in the future and assigning it to your Twitter profile, you must log out of Twitter before visiting our website.

12.3 Google+

Plug-ins of the social network Google+ of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google") are integrated on our pages. When you visit a page of ours that contains such plug-ins, your browser establishes a direct connection to a Google server. The content of the plug-ins is transmitted directly to your browser and integrated into the website. In this process, data is automatically transmitted to Google in the USA and stored there on their servers. This transmitted data includes connection data (such as your IP address, date and time, the URL called up) as well as the browser used and the operating system. Your visit to our pages can thus be tracked by Google, even if you do not actively use the plug-in functions.

If you are logged in with your Google+ account while visiting our website, Google can directly assign the visit to our pages to your user account. If you wish to prevent this direct association, you must log out of Google+ before visiting our website.

Information on the purpose and scope of data collection and the further processing and use of the transmitted data through the use of Google+ plug-ins is contained in Google's privacy policy (https://www.google.com/policies/privacy/partners/). These also contain information and links to your rights and the possibilities of settings to protect your privacy.

We use the integrated Instagram buttons to provide a link to our Instagram profile. A widget is also integrated, which enables us to display certain photos and videos from our Instagram profile on our website.

When you visit one of our pages that contains such a plug-in, your browser establishes a direct connection to an Instagram server. The content of the plug-ins is transmitted directly to your browser and integrated into the website. In this process, data is automatically transmitted to Instagram and stored on their servers. This transmitted data includes connection data (such as your IP address, date and time, the URL called up) as well as the browser used and the operating system. Your visit to our pages can thus be tracked by Instagram, even if you do not actively use the plug-in functions.

Accordingly, cookies for recording user behaviour are only set when the video is played. If you are logged into your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right.

We have no knowledge of and no influence on the possible collection and use of your data by YouTube. You can find more information in YouTube's privacy policy at https://www.google.de/intl/de/policies/privacy.

LinkedIn records information that our corresponding pages with the LinkedIn plugins were loaded in your web browser. 13.2 Use of Google Maps

On our homepage, we use Google Maps to display maps and for better route planning and location determination for our customers (legal basis in accordance with DSGVO: Art. 6 Abs. 1 lit. f with the operation of our website and the consideration of the interests of the data subjects). Google LLC in the USA has undertaken to ensure adequate data protection in accordance with the American-European and the American-Swiss Privacy Shield. Further information on this can be found in Google's detailed privacy policy https://www.google.com/policies/privacy.

13.3 Use of Google AdWords Conversion Tracking

We use the online advertising programme "Google AdWords" and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"). When you click on an ad placed by Google, a cookie for conversion tracking is placed on your computer. These cookies lose their validity after 30 days, do not contain any personal data and are therefore not used for personal identification.

If you visit certain web pages on our website and the cookie has not yet expired, Google and we can recognise that you clicked on the ad and were redirected to that page. Each Google AdWords customer receives a different cookie. Thus, there is no possibility that cookies can be tracked across the websites of AdWords customers.

The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. Here, the customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in the tracking, you can object to this use by preventing the installation of cookies through a corresponding setting in your browser software (deactivation option). You will then not be included in the conversion tracking statistics. Further information and Google's privacy policy can be found at: http://www.google.com/policies/technologies/ads/, http://www.google.de/policies/privacy/

13.4 Use of Google AdSense

This website uses Google AdSense, a service for integrating advertisements from Google Inc ("Google"). The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google AdSense uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. Google AdSense also uses so-called web beacons (invisible graphics). Through these web beacons, information such as visitor traffic on these pages can be evaluated.

The information generated by cookies and web beacons about the use of this website (including your IP address) and the delivery of advertising formats is transmitted to a Google server in the USA and stored there. This information may be passed on by Google to contractual partners of Google. However, Google will not merge your IP address with other data stored by you.

The storage of AdSense cookies takes place on the basis of  Art. 6 Abs. 1 lit. f DSGVO. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

13.5 Doubleclick by Google

A pseudonymous identification number (ID) is assigned to your browser through the use of cookies. These cookies do not contain any personal data. This is done to enable Google and its partner websites to display targeted advertising based on your previous visits to our and other websites.

This service provider processes the following data:

  • Device category
  • Website
  • Channel
  • Advertising material
  • Targeting selection
  • Conversion-ID

Disable: You can prevent the collection and use of the data generated by Google using the cookies. To do this, deactivate the Doubleclick cookies on the Digital Advertising Alliance website under the following link www.aboutads.info/choices or install the browser plugin available under the following link www.google.com/settings/ads/plugin.

13.6 Facebook Pixel

This website uses the visitor action pixel from Facebook, Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") for conversion measurement.
This makes it possible to track the behaviour of page visitors after they have been redirected to the provider's website by clicking on a Facebook ad. This allows the effectiveness of the Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimised.
The data collected is anonymous for us as the operator of this website, we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage policy Facebook data usage policy. This allows Facebook to serve ads on Facebook pages as well as outside of Facebook. This use of the data cannot be influenced by us as site operator.
The use of Facebook Pixel is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in effective advertising measures including social media. If a corresponding consent has been requested (e.g. consent to the storage of cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.
You can find further information on protecting your privacy in Facebook's data protection information: https://de-de.facebook.com/about/privacy/.
You can also deactivate the "Custom Audiences" remarketing function in the settings section for advertisements at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. To do this, you must be logged in to Facebook.
If you do not have a Facebook account, you can disable Facebook's usage-based advertising on the European Interactive Digital Advertising Alliance website: http://www.youronlinechoices.com/de/praferenzmanagement/.

If you reasonably object to such changes, you may notify WhatsApp in writing and terminate your use of our Business Services; and
    6. upon termination of the Business Terms, WhatsApp shall cease processing and delete the personal data as soon as reasonably possible. 15. Other

15.1 Photographs

We process photographs and film footage and, if applicable, names and first names at open events, e.g. campaigns, festivals, competitions, etc. The photos are taken as part of the events, usually by our employees. In some cases, we also hire external photographers whom we involve in accordance with data protection law and who we prohibit from using the photographs for their own purposes.

We use the photographs and film footage to report on our events. The pictures of the open events will be published if necessary:

  • on our website
  • Flyers
  • in the annual report
  • in internal presentations
  • on social networks (e.g. Instagram, Facebook)

The legal basis for the production of overview and group pictures of events that do not specifically depict individual persons in the portrait shot or children is our justified interest in reporting our activities in accordance with  Art. 6 Abs. 1 lit. f DS-GVO.

The legal basis for the publication of the photographs and film footage is our legitimate interest pursuant to Art. 6 Abs. 1 lit. f DS-GVO i. V. mit §§ 22 und 23 KunstUrhG. We will only publish photographs and film footage of you without your consent if this is in our overriding legitimate interest in documenting and reporting on our activities, which is the case with footage in which individuals are only "accessories" or we publish overview or group pictures of the events in which you participated.

Your data will be viewed internally by the relevant departments for the aforementioned purposes. If we have used the services of external photographers, we receive the photo files from them.

Our data processing takes place in Germany and in the EU, there is no transfer of data to a third country or an international organisation.

The photo and, if applicable, film data and personal data are stored indefinitely, as this is the only way we can achieve permanent documentation of our activities, also in the historical interest.

There is no obligation to provide your data, i.e. you do not have to allow yourself to be photographed and/or filmed by us and provide us with your first and last name. If you do not wish to be photographed, please inform the photographer immediately.
